Yan Skwara, being duly sworn, deposes and says: 1. I am the President and CEO of Sammy's Produce, Inc. and make this declaration

in support of an application for a default judgment. 2. I am personally familiar with all matters which are the subject of this proceeding

and the facts set forth in this declaration are within my personal knowledge. If called upon as a witness, I would and could competently testify to all facts stated in this declaration. 3. Attached hereto as Exhibit A is a chart showing the interest owed on the open

balance for each month between July 2007 and July 2008. The one and one half percent interest per month is based on the 18% annual interested reflected on Sammy's Produce, Inc. invoices permitted by PACA, as alleged in paragraph 24 of the Complaint.
