the July 1, 2008, ex parte Order granting Plaintiffs application for TRO is
GRANTED.

Gordon C. Young failed to disclose to this Court when seeking an ex parte

TRO that: (1) a valid and binding arbitration agreement existed between the
paries, and (2) a venue provision required Plaintiff to seek preliminar injunctive

relief from a trbunal in Milwaukee, Wisconsin. As such, Plaintiffs motion for
the ex parte TRO was frvolous. The law firm of Keesal Young & Logan shall be

held jointly responsible for its parer's filing of the frvolous motion.

A monetar sanction shall issue in the amount of reasonable attorneys'

fees and costs, which shall be determined at a hearng upon this matter. Counsel
for Defendant Green shall coordinate the hearng and set it with the Court.
