UNITED STATES DISTRICT COURT 5 DISTRICT OF ARIZONA 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Defendant Wayne Charles Bryan, by and through the undersigned, respectfully submits the Defendant's Motion to Continue Dispositional (Supervised Release) Hearing, also known as an "admit/deny" hearing until such time as the proceedings in United States v. Wayne Charles Bryan, CR-08-0234-PHX-JAT, which is before the Court presently pursuant to a new indictment, have been completed. The hearing is currently set for May 6, 2008. The outcome in the new case will necessarily impact on the defendant's decision on how to proceed in this case. Should the defendant be required to proceed in this case before an outcome is reached in the newer case, the record may possibly be used against him in that case if the results show he has violated supervised release conditions, particularly if he makes an admission to that effect.. The Assistant U. S. Attorney assigned to this case, James Knapp, is currently in trial and has not had a chance to respond to the undersigned concerning the government's position on the requested extensions of time. It is expected that excludable delay pursuant to Title 18, United States Code, Section 3161(b)(1)(F) may occur as a result of this motion or from an order based thereon.. / / / United States of America, CR-00-0185-001-PHX-JAT Plaintiff, v.
