19 Maricopa County defendants object to the pleading Hled by Mr. Trimble
20 entitled "Permission to Amendment to Conform to the EvIdence." The Federal
21 Rules of Civil Procedure do not provide for any such pleading. It is difticult to
22 ascertain the intended nature of this pleading. If it is meant to be a disclosure

1 statement, no responsive pleading is necessary. If it is meant to be a Motion for
2 Leave to Amend the Complaint, Defendants object as it is untimely and
3 prejudicial. Defendants have tiled a well-taken Motion for Summary Judgment
4 on the Complaint. Plaintiff has responded and the parties await the Court’s
5 decision.
6 Moreover, TrimbIe’s "evidence" is no more than unsworn argument.
