Upon motion of the defendant to continue to trial date and in order to avoid a

miscarriage of justice, the court finds that for the reasons set forth in the motion, the ends of
14

justice served by the granting of such continuance outweigh the best interest of the public
15

and the defendant in a speedy trial. The Court finds that failure to grant such a continuance
16 would unreasonably deny counsel for the defendant the reasonable time necessary for effective 17 preparation, taking into account the exercise of due diligence. 18 U.S.C. ยง 3161(h)(8)(B)(iv). 18

IT IS HEREBY ORDERED that the defendant's request for a continuance of the
19

December 13, 2005 trial date is granted.

IT IS FURTHER ORDERED that the case is continued for trial to February 14, 2006
21

at 9:00 a.m. in Phoenix.

IT IS FURTHER ORDERED that excludable delay in order to avoid a miscarriage
23

of justice is therefore found to have commenced on December 13, 2005 for a total of 63 days
24

pursuant to Title 18 U.S.C. Section 3161(h)(1)(A).
