On May 18, 2005, Magistrate Judge Duncan issued an Order styled "Findings and
1 7 Recommendation of the Magistrate Judge Upon a Plea of Guilty." In the Order, he
1 8 recommends to the District Court that this Judge accept the Defendant's plea of guilty,
1 9 subject to the Court's acceptance ofthe Plea Agreement. The Court having reviewed this
2 O matter de novo, and no objections having been filed pursuant to 28 USC § 63 6(b)( 1), finds
2 1 that it will accept the Recommendation of Magistrate Judge Duncan.
2 2 Accordingly,
2 3 IT IS HEREBY ORDERED accepting the Defendant's plea of guilty.
2 4 IT IS FURTHER ORDERED that the plea agreement will not be accepted or
2 5 rejected at this time but the matter will be referred to the Probation Office for report and
ii recommendation. In this connection, the Defendant may be interviewed by the Probation

2 officer and the Court will inspect the presentence report for the purpose of determining
