UNITED STATES OF AMERICA, Plaintiff, vs. BRANDI LYNN McCRORY, Defendant
) ) ) ) ) ) ) ) ) )
Case No.: CR-04-0777-PHX-DGC MOTION TO CONTINUE TRIAL (Assigned to The Honorable David G. Campbell)
Defendant, Brandi Lynn McCrory, through undersigned counsel, asks this Court to continue the trial date for a period of thirty (30) days from the current date of September 13, 2005. The reasons for the requested continuance is that the defense is continuing its investigation and discovery in this matter and requires additional time to complete these matters prior to trial. Defendant requests that this Court continue the current trial in order to allow for this trial preparation, and the interests of justice will best be served by this continuance. Defense counsel has communicated with the Assistant United States Attorney's office concerning this motion, and the government, through Andrew Pacheco, has no objection to the requested continuance. Excludable delay under 18 U.S.C. ยง3161(h)(8)(A) may result from this motion.
