Defendant, MARCIAL AVILA-ANGUIANO, through counsel, respectfully requests an

extension of any deadlines and a 30-day continuance of the Sentencing set for August 25, 2008.

This request for continuance is made for the following reasons:

Defense counsel continues to obtain and prepare documentation that may be beneficial to defendant at sentencing. Thus, the ends of justice will be served by a continuance and it outweighs the best interests of the public or defendant. Denial of the motion would result in a miscarriage of justice. Defense counsel will be in trial in United States v. David Early, CR07-0291-TUC-FRZ. Defense counsel is co-counsel, both he and lead trial counsel are preparing witnesses and pre-trial motions will be heard on August 25, 2008. Assistant United States Attorney, Joe Koehler, has no objection to this request. Beth Stewart, United States Probation Office, has no objection to this request.
