The United States of America, by and through its attorneys undersigned, and Defendant, James David Snow, hereby respectfully move this Court for an order continuing the trial date from December 6, 2005, for a period of 30 days. The reason for the requested continuance is that defendant yesterday presented the government sworn statements from the co-occupants of the home from which the firearms at issue in this case were seized. The parties believe it is in the best interests of justice to continue trial in this matter for thirty days to enable the government to investigate the information contained in the sworn statements. Such investigation may lead to a pre-trial resolution of this matter. Defendant's attorney, Mark S. Iacovino, joins in this motion. The parties request that the Court grant this motion as it will serve the ends of justice. It is expected that excludable /// /// ///
