Defendants Maricopa County Department of Transportation, Medlin, Peterson and Ramsey respectfully request the Court for permission to have until October 21, 2005 within which to file their Reply in support of their summary judgment motion. Defendants filed their motion for summary judgment on April 1, 2005 (Item #40). Plaintiff responded on April 15, 2004 (Item #47). Plaintiff moved for a stay on May 12, 2005 due to his bankruptcy (Item #52). Plaintiff has just recently filed a notice of bankruptcy discharge (Item #57).
