Pursuant to Fed. R. Civ. P. 62(d), Plaintiff, the Equal Employment Opportunity Commission ("Commission") and Plaintiff Intervenor Kelley Miles hereby move this Court for an Order staying the taxation of costs because the Commission and Ms. Miles anticipate filing an appeal. The Commission and Ms. Miles are reviewing their options and anticipate appealing the judgment of the Court in this action. If they file a notice of appeal, the Commission and

Ms. Miles are entitled to a stay of the proceedings to enforce the judgment. See Fed. R. Civ. P. 62(d)-(e). Therefore, the Commission and M s. Miles request that the Court stay the taxation of costs, and that the stay be in effect until the deadline for the Commission and Ms. Miles to file a notice of appeal, December 5, 2005, or until a decision on appeal, if notice is filed.
