Pursuant to Defendant's motion to continue, the Government not objecting, and good

cause shown therein, to wit: A competency hearing is scheduled for August 14, 2008.

IT IS HEREBY ORDERED that the Defendant's motion to continue is granted
15
pursuant to 18 USC §3161(h)(8)(A) and continuing the trial currently set for August 5, 2008,
16
to October 7, 2008 at 8:30 a.m. and extending the motion deadline until August 29, 2008 .

This Court specifically finds that the ends of justice served by granting a continuance
18
outweigh the best interests of the public and the Defendant in a speedy hearing and trial.

This finding is based upon the Court's conclusion that the failure to grant such a continuance
20
would deny the Defendant the reasonable time necessary for effective preparation, taking into
21
account the exercise of due diligence. 18 USC §3161(h)(8)(B)(iv).

EXCLUDABLE DELAY pursuant to 18 U.S.C. §3161(h)

is found to
commence on 7/22/08 for a period of 78 days.
