On 6/30/2003 the defendant, present with counsel, appeared for sentencing for violating, Title 8, U.S.C. §1326(a),
lllegal Re-Entry after Deportation, with sentencing enhancement pursuant to Title 8, U.S.C. §1326(b)(2), a Class C
Felony offense, as charged in Count 1 of the indictment filed herein.
The defendant was sentenced to a term of THIRTY SEVEN (37) MONTHS
imprisonment and upon release, THREE (3) YEARS of supervised release to follow.
On 3/22/06 the United States Attorney filed a petition to revoke the term of supervised release.
On 4/16/07 the defendant appeared with counsel and admitted allegation as reflected in the petition to revoke filed in
this matter. The matter now comes on for disposition.
, IT IS ORDERED that the term of supervised release imposed on 6/30/2003 is hereby REVOKED and the defendant I
I is committed to the custody of the Bureau of Prisons for a term of SEVEN (7) MONTHS, with a term of NO supervised
release to follow. Disposition imposed shall run concurrent with the sentence imposed in CR-06-00311-TUC-FRZ(JJM).
IT IS FURTHER ORDERED that the defendant is given credit for time served.
The Court orders commitment to the custody of the Bureau of Prisons
The defendant is advised of defendant's right to appeal within TEN (10) DAYS of entry of judgment.
