27 parties in the above—entitled action, as the Court granted Defendants’ Motion under F.R.C.P. for
28 Judgment as a Matter of Law and entered judgment in Defendants’ favor on March 1, 2006. As set

1 forth in the concnrrent1y—filed Amended Bill of Costs and Beclaration of Carrie Flynn in support of
2 Amended Bill of Costs ("Flynn Decl."), Defendants are entitled to an award of taxable costs in the
3 amount of $18,479.58. Defendants’ Bill of Costs has been amended in three respects. First, at the
4 request ofthe Clerk of Court, the relevant invoices are being submitted as exhibits to the Flynn Decl.
5 Second, the original Bill of Costs incorrectly included the deposition transcript cost for a deposition
6 that was not taken in connection with this action; therefore, that cost ($1,105.00) has been reduced
7 from the "Deposition/Court Reporter liees" amount. Finally, the airfare expense for Bruce Webb’s
8 anticipated trial testimony was $l,l72.62, but was incorrectly listed as $1197.60; therefore, $25.00
9 has been reduced troni the "Fees/Expenses for witnesses” amount.
