NOTICE OF REMOVAL Defendant, Terex Corporation d/b/a Terex Construction Americas, pursuant to 28 U.S.C. §§ 1332, 1441 and 1446, and D. Del. LR 81.1, hereby gives notice of the removal of this case and states as follows: 1. This case was commenced in the Superior Court of Delaware in and for New
Castle County and is now pending in that Court. Process was served on Defendant on August 6, 2008. A copy of Plaintiff's Complaint setting forth a claim for relief upon which the action is based is attached hereto and marked as Exhibit 1. A copy of the summons issued for
Defendant is attached hereto and marked as Exhibit 2. A copy of the letter from Defendant's agent for service of process of the Complaint is attached hereto and marked as Exhibit 3. 2. According to the Complaint, Plaintiff is a Florida corporation with its principal
place of business in Florida. 3. Connecticut. 4. This is a civil case over which the District Courts of the United States have Defendant is a Delaware corporation with its principal place of business in
original jurisdiction pursuant to 28 U.S.C. §1332. The action is between citizens of different states and the amount in controversy exceeds the value of $75,000.00. Attached hereto and marked as Exhibit 4 is a letter dated August 14, 2008, from counsel for Defendant to counsel for
