DEFENDANT’S OBJECTION TO MOTION TO COMPEL
The Defendant in the above-referenced matter hereby tiles its objection to the Plaintiffs
Motion to Compel dated July 9, 2004. In support of its objection, Defendant asserts that it has
provided Plaintiff with copies of the entire personnel files of Ronald Gagnon and Jesse Knight,
by way of Supplemental Disclosure.
In addition, Defendant notes that Plaintiffs Motion does not conform to the requirements
of Federal Rules of Civil Procedure Rule 37 (a)(2)(A), inasmuch as it does not contain a
certification of a good faith effort to secure the disclosure without court action.
Accordingly, Defendant respectfully urges the Court to deny the Motion to Compel
without sanction.
