Anderson of Wells, Anderson & Race LLC, and pursuant to D.C.COLO.LCivR 7.1(E), hereby gives notice to the Court of a recent decision from the Tenth Circuit Court of Appeals which may impact this Court's resolution of particular issues raised in Defendant's Motion for Summary Judgment [Docket No. 40, filed September 1, 2004] and Defendant's Response to Plaintiff's Motion for Partial Summary Judgment [Docket No. 48, filed September 28, 2004]. 1. On December 30, 2005, the Tenth Circuit Court of Appeals issued a decision

affirming the decision of the United States District Court's decision in Clark v. State Farm Mut. Auto. Ins. Co., 292 F.Supp. 1252 (D.Colo. 2003)(Babcock, J) (in which the District Court limited the amount of enhanced PIP benefits incorporated through judicial reformation to the policy's $200,000 Aggregate Limit). See Clark v. State Farm Mut. Auto. Ins. Co., Nos. 04-1022 and 04-1023 (10th Cir. December 30, 2005). A copy of that decision is attached as Exhibit A.
