On June 30, 2005, a United States District Court Judge for the District of Colorado

issued an Order and Memorandum Decision in Folks et al. v. State Farm Mut. Auto. Ins. Co., Civil Action No. 04-cv-00243-EWN-BNB (D.Colo. June 30, 2005), which distinguished offers of enhanced personal injury protection (PIP) benefits under C.R.S. § 10-4-710 from the written explanation requirement of C.R.S. § 10-4-706(4). A copy of that decision is attached as Exhibit A.
