David Kraig, tirst duly sworn upon his oath states the following:
1. I am now, and have been an Emergency Medical Technician with
the City of Phoenix Fire Department since 1974 and a Captain
since 1989.
2. While on duty as the Captain of Phoenix Fire Department Engine
30, I participated with my crew in the evaluation and treatment of
Robert Krumlauf on October 24, 2003 in a residential backyard
located at 3151 West Ruth Avenue in Phoenix, Arizona. This
evaluation and treatment is the subject of Departmental Report
03-232322.
3. I am aware of the subject of the lawsuit entitled Krumlauf v.
Phoenix Police Officer Michael Meeihuysen, et al., United States
District Court No. CV 04-0720-PHX—ROS (LOA).
4. On October 24, 2003, at approximately 9:00 p.m., my crew was
dispatched to 3151 West Ruth Avenue based on a police request.
5. We arrived at approximately 9:10 p.m. and observed Robert
Krumlauf to be handcuffed and laying on the ground in the
backyard of the residence.
6. Robert Krumlauf compiained of pain and tenderness to his left
ankle, claiming it was the result of him tripping as he ran through
the backyard.
7. We observed minor swelling to Robert Krumlaufs left ankle.
8. We observed that Robert Krumlauf was able to move his left toes
and his left ankle and was able to walk.

9. We determined that Robert Krumlaufs injury was not serious.
10. We determined that Robert Krumlauf was stable and did not need
to go the hospital.
11. We treated Robert Krumlauf with an ice pack and concluded our
involvement at the scene.
12. None of the police ofticers at the scene interfered in any way with
our evaluation and treatment of Robert Krumlauf.
13. During my involvement in this case, Robert Krumlauf identified
himself as Robert Cauloff with a date of birth of March 3, 1967.
