Defendant El Shaddai Ministries and His Successors, a Corporation Sole ("El Shaddai"), a Nevada corporation, hereby gives notice that it is withdrawing its Motion to Dismiss Presenting Defense of Rule 12: Lack of Jurisdiction Over Subject Matter; Lack of Jurisdiction Over Person; Improper Venue; Failure to State a Claim; Failure to Join a Party Under Rule 19, which El Shaddai mailed to the Clerk earlier this week.1 El Shaddai has retained undersigned counsel to represent it in this litigation and El Shaddai has filed today its request for an additional two weeks to respond to the Second Amended Complaint. Assuming that motion is granted, undersigned counsel will file a responsive pleading to the Second Amended Complaint on behalf of El Shaddai by February 3, 2006. DATED this 20th day of January, 2006.
