1 this Court for an expedited ruling on his Motion for Rule 54(b) Certification of its March
2 24, 2005 Order and Judgment, dismissing, for lack of jurisdiction, the federal defendants
3 in this matter. Plaintiff seeks to maintain his appeal before the Court of Appeals for the
4 Ninth Circuit, in which oral argument is set for February 16, 2007. Plaintiff advises the
5 court that he has advised the appellate court of what he seeks from the instant court, in
6 addition to seeking from the appellate court a limited remand for the purpose of obtaining
7 Rule 54(b) certification.
