UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA United States of America, Plaintiff, v. ORDER CONTINUING JURY TRIAL Teddy Lee Lowe Defendant. Upon motion of the defendant for ninth request for extending time to file pretrial motions and continue trial, no objection from the government and good cause appearing, IT IS HEREBY ORDERED continuing the pretrial motions deadline from the current date of August 29, 2005, to September 28, 2005. This court specifically finds that the ends of justice served by taking this action outweigh the best interest of the public and the defendant in a speedy trial. This finding is based on the court's conclusion that the failure to grant such a continuance would unreasonably deny the defendant continuity of counsel and would deny the attorney for defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. § 3161(h)(8)(b)(IV). IT IS FURTHER ORDERED continuing the trial in No. CR-04-487-2-PHX-ROS from the current date of October 4, 2005, to November 1, 2005, at 8:30 a.m., in Phoenix, Arizona. /// CR04-487-2-PHX-ROS
