CR 04-468-1 PHX-SMM ORDER REINSTATING PROBATION

A petition for revocation of probation having been filed, hearings held with the defendant and counsel present, and the defendant having admitted. The Court finds defendant's probation be reinstated. The Court has considered the U.S. Sentencing Commission Chapter 7 policy statements as well as the original guideline range and the disposition reports and any attachments. IT IS ORDERED reinstating the defendant's probation, under original terms and conditions as previously imposed, with the following special conditions: 1. You shall participate as instructed by the probation officer in a program of substance abuse treatment which may include testing for substance abuse. You shall contribute to the cost of treatment in an amount to be determined by the probation officer.

You shall submit your person, property (including but not limited to computer, electronic devices, and storage media), residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable manner.

You are prohibited from owning, maintaining or using a firearm.

4.

You shall not be involved with gang activity, possess any gang paraphernalia or associate with any person affiliated with a gang.

You shall support all lawful dependants. You shall reside and participate in Behavioral Systems Southwest Treatment Facility or Recovery Homes Facility for 180 days, unless discharged earlier by the probation officer.

7.

The defendant shall maintain full-time employment as directed by the probation officer. You must have a valid driver's license and valid car insurance.

8.

You shall cooperate in the collection of DNA as directed by the probation officer.

The defendant is advised of his right to appeal within 10 days. The defendant remanded to the custody of the United States Marshal until bed space becomes available at a substance abuse treatment facility.
