The Court is in receipt of Plaintiff's letter to the Court seeking assistance in sending payment of the $150.00 filing fee he incurred by filing this action, which was dismissed on October 18, 2004. Pursuant to 28 U.S.C. § 1915(b)(2), the filing fee is collected monthly in payments of 20 percent of the previous month's income, each time the amount in the account exceeds $10.00. However, because Plaintiff has extra money in his inmate trust account, he would like to send more. Plaintiff requests that the Court intervene to require ADOC to send additional money from Plaintiff's trust account to the Court to pay his fee expeditiously. However, the Court does not have the authority to order ADOC to remit money on Plaintiff's behalf from Plaintiff's trust account. If Plaintiff wishes to pay the filing fee for this action more quickly, he should have a friend or a member of his family make a payment to the Court referencing the case number: CV 03-2141-PHX-MHM (MS). ///
