I NOTICE IS HEREBY GIVEN that pursuant to Local Rule 54.2 Defendants and
2 Counterclaimants, RONNIE L. COOK and RONNIE L. COOK, D.D.S., M.S.D. PC ("Dr. Cook")
3 will, and hereby do, move this Court for an order awarding Cook attorneys’ fees and costs in this
2 case. This motion is made based on the Court’s January 26, 2006, order dismissing the complaint
6 for failure to prosecute. Paragraph 9.10 of the Business Management Agreement alleged in the
7 Complaint provides that the prevailing party in a legal action brought to enforce or defend rights
8 under the Agreement "shall be entitled to recover its costs and reasonable attorneys’ fees in
9 addition to any other relief granted."
10 A fair estimate of the attomeys’ fees sought by Dr. Cook is $89,000.00. A fair estimate o
ll the costs sought by Dr. Cook is $49,000.00.
12 The motion will be based on this notice of motion, on the memorandum of points and
1 3 authorities to be served and filed at a later date, anticipated declarations by counsel, on the
14 records and iile herein, and on such evidence as may be presented at the hearing of the motion.
