Plaintiffs, by and through undersigned counsel, hereby respond the COLll`I`S Order

dated November 22, 2005 for Plaintiff to show cause in writing why this case should not

be dismissed for lack of prosecution. For the reasons discussed beiow, this case shouicl

except for one document;

25 3. Plaintiffs estimate that it will take an additional two weeks to execute all
of the settlement documents;

I 4. The delay in getting the negotiated settlement documents drafted,
approved and executed has been primarily due to the fact that Orthodontic
3 Centers of America, inc. is based in Metarie, Louisiana, a suburb of New
Orleans. The two hurricanes caused its headquarters to be shut down and
3 for key individuais (needed to iinalize the settiement) to be scattered
4 around the country.
5 For these reasons, Plaintiff requests a thirty (30) day extension to finalize and

execute the settlement documents and to tiie a stipulation and form of order for

dismissal with preiudtce.
