The Receiver, and real parties in interest, Noily Cope, Barry T. Jordan Jr. and Gail M. Christensen, as Conservator for G.J., a minor (hereafter "Movants"), respectfully move the Court to vacate the Order to Show Cause on Civil Contempt [Doc. #372] entered by the Court setting this matter for hearing on April 28, 2008, at 1:30 P.M.

On February 8, 2007, the Court entered its Order Re: Petition No. 24 [Doc. #336], which, among other things, ordered Barry Jordan Sr. ("Jordan") to "vacate the single family residence located at 10620 N. 84th Street, Scottsdale, Arizona (hereafter the "Property")."1 Jordan refused to comply with the demands of the Receiver that he vacate the Property as ordered by the Court. Accordingly, on February 14, 2008, the Movants filed their Joint Motion to Hold Barry T. Jordan Sr. in Civil Contempt of Court, Re: Petition No. 24 [Doc. #368] seeking, among other things, an order requiring Barry T. Jordan, Sr. to appear before the Court to show cause why the Court should not enter an order holding him in civil contempt of Court and sanctioning him as appropriate ("Motion"). The Court on March 27, 2008, entered its Order to Show Cause on Civil Contempt [Doc. #372] setting this matter for hearing on April 28, 2008, at 1:30 P.M. No response to the Motion was filed by Jordan as required under the Order to Show Cause on Civil Contempt [Doc. #372]. Subsequent to the preparation and filing of the Motion, Jordan removed himself and some of this personal property from the Property, however, he failed to remove all of the personal property and various trash. After repeated demands by the Receiver that Jordan remove the trash and personal property left behind, the Receiver was forced to expend receivership assets to remove the trash and personal property at an expense of at least $1,960.00. Demands on Jordan to pay this expense have been ignored. The Movants do not wish to incur further attorneys fees on this Motion at this time, since if the Court's Order Re: Petition No. 24 [Doc. #336] is affirmed on appeal to

the Ninth Circuit2, the receivership will be reimbursed for its expenses caused by the contempt from the net sale proceeds of the Property. If however, the Order is reversed on appeal, the Movants intend to renew the Motion in order to obtain a monetary judgment for the damages caused by Jordan's contempt. Counsel for Jordan has advised counsel for the Receiver that he does not oppose an order vacating the Order to Show Cause on Civil Contempt [Doc #372], the relief requested herein.
