On February 22, 2006, this Court granted partial summary judgment in favor of

19 Brown & Bain and against Defendants. The Court's ruling covered all time billed by 20 Brown & Bain to O'Quinn except for time spent on two satellite disputes, one involving a 21 prior lawyer for the McIntire plaintiffs whose name was "Harvey," and the second 22 involving one of the McIntire plaintiffs named "Farr." In its March 20, 2006 Motion for 23 Entry of Judgment [Dckt. No. 148], Brown & Bain indicated that it was no longer 24 pursuing these matters, and Defendants did not object. 25 Thereafter, on April 12, 2006, this Court signed its Final Judgment in favor of

26 Brown & Bain, P.A. and against Defendants [Dckt. No. 152] ("the Judgment"). The 27 Judgment was entered by the Clerk on April 17, 2006. This Judgment excluded any 28 amounts for the "Harvey" and "Farr" matters.

The parties stipulate that Brown & Bain's claims as to time billed to O'Quinn for work on the "Harvey" and "Farr" matters only have been dismissed and were excluded from the Judgment. DATED: April 18, 2006. LEWIS AND ROCA LLP
