CR 03-987-01-PHX-DGC ORDER REVOKING PROBATION

A petition for revocation of probation having been filed and hearings held with the defendant and counsel present, and the defendant having previously admitted violations of a court order, IT IS ORDERED revoking the defendant's probation and the defendant, Richard Anthony Dennis, shall be committed to the custody of the Bureau of Prisons for a term of SIX (6) MONTHS. Defendant shall self surrender to the United States Marshal Service not later than January 30, 2008 at 11:00 a.m. The Court recommends the defendant be placed in an institution in Arizona if possible. IT IS FURTHER ORDERED upon release from the Bureau of Prisons, defendant is placed on supervised release for a period of THIRTY SIX (36) MONTHS. IT IS FURTHER ORDERED affirming standard conditions of supervision adopted by the Court in General Order 05-36 previously imposed. The Defendant shall comply with the following additional conditions:

You shall participate as instructed by the probation officer in a program of substance abuse treatment which may include testing for substance abuse. You shall contribute to the cost of treatment in an amount to be determined by the probation officer.

You shall submit your person, property (including but not limited to computer, electronic devices, and storage media), residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable manner.

You shall provide the probation officer access to any requested financial information. You are prohibited from making major purchases, incurring new financial obligations, or entering into any financial contracts without the prior approval of the probation officer.

You shall participate in a mental health program as directed by the probation officer which may include taking prescribed medication. You shall contribute to the cost of treatment in an amount to be determined by the probation officer.

The defendant shall maintain full-time legitimate and verifiable employment as directed by the probation officer.

You shall abstain from all use of alcohol or alcoholic beverages. You shall pay the balance of restitution of $114,167.00 in regular monthly payments as directed by the probation officer. Payments are to commence 30 days after release from incarceration. Payments are to be made payable to Clerk, U.S. District Court. The defendant is advised of his right to appeal within 10 days.
