BACKGROUND
Pursuant to the Courts order dated August 26, 2005 (Docket # 66), a hearing on
all pending motions in lfmfne has been scheduled for September I4, 2005.
Plaintiffs counsel will be in Washington, D.C. on September I3, 2005
(Tuesday), attending the deposition ol` an NTSB representative in an unrelated case.
Plaintit`1%' counsel will be in Montreal, Quebec, Canada on September 15, 2005
(Thursday`) attending the depositions of expert witnesses in another unrelated case.
Accordingly, plaintiffs’ counsel has a scheduling conflict that will prevent counsel from
attending the hearing in Phoenix on Wednesday, September 14, 2005.

STIPULATION
Based on the foregoing, the parties have stipulated that the hearing on the
motions in limine may be continued for one week, until September 21, 2005, at 4:00
p.m. A proposed order is lodged herewith.
