STIPULATION AND ORDER OF DISMISSAL
Pursuant to Fed. R. Civ. P. 4l(a)(l)(A)(ii), Plaintiffs and Counterclaim
Defendants Boehringer Ingelheim Phaima GmbH & Co. KG, Dr. Karl Thomae GmbH,
Boehringer Ingelheim Intemational GmbH, and Boehringer Ingelheim Pharmaceuticals, Inc. and
Defendant and Counterclaim Plaintiff Bair Laboratories, Inc., being all parties to this action, and
having entered into a settlement agreement, hereby stipulate that Civil Action No. 07-432, and
all claims and counterclaims for relief asserted therein, are hereby dismissed with prejudice.
Each party shall bear its own costs and attorney fees.
The Court shall retain jurisdiction over the parties and this action to the extent
necessary to enforce the terms of the settlement agreement.
