JOINT STATUS REPORT Pursuant to this Court's Order of June 26, 2008, the Plaintiff, L. Tim Wagner, Liquidator of Amwest Surety Insurance Company in Liquidation ("Liquidator") and the Defendant, the United States of America ("Government"), hereby submit the following status report. The Amwest Liquidator and the U.S. Government have reached final settlement terms. The settlement has been approved by all affected U.S. Government agencies. The parties are

working through the final wordings of a formal settlement agreement and are preparing an application for approval of the settlement by the District Court of Lancaster County, Nebraska, the court overseeing Amwest's liquidation. The parties expect to file a dismissal of this action in the near future.
