l 1. The motion at docket 11-1 for a hearing is still being tracked. To clear the
l docket, the motion at docket 11-1 is DENIED without prejudice.
2. The parties shall promptly confer and then on or before July 18, 2005,
counsel for defendant shall file a report of the type contemplated by Fed. R. Civ. P.
26(f) updated to reflect the current state of the litigation. lt is the court's intention to use
that report to prepare a scheduling order pursuant to Fed. R. Civ. P. 16(b) so that this
ageing case can be moved forward toward as prompt a resolution as possible. _
