Based upon the Financial Affidavit provided to the Court this date, the Court makes a conditional finding that the defendant is indigent. The Court shall appoint Craig Orent of the Federal Public Defender's Office to represent the defendant. The defendant is advised that this is a conditional appointment and subject to the Court determining at a future date whether or not the defendant has adequate assets to fund his own case. Lawrence A. Hammond (retained) and the law firm of Osborn Maledon shall be allowed to withdraw as counsel of record and relieved of any further responsibility in this case upon signing and docketing of a formal written order. IT IS ORDERED that the defendant provide his 2006 and 2007 tax returns and any other documents or exhibits supporting defendant's financial presentation to the Government by 12:00 noon, Monday, April 21, 2008. (The Court is advised by the defendant that he has not yet filed his 2007 tax returns.)
