27 the subject matter, currently scheduled to commence on October 4, 2005. As more fully
28 detailed in the attached Declaration of William L. Robinson, Defendants’ lead trial counsel

1 wasrecently diagnosed with a potentially serious medical condition that requires almost
2 immediate treatment. The decision to deny or grant a continuance lies within the broad
3 discretion of the trial court. See United States v. Gonzales-Rincon, 36 F.3d 859, 865 (9th Cir.
4 1994). Rule l6(b) of the Federal Rules of Civil Procedure permits trial courts to modify
5 scheduling orders upon a showing of good cause. See Fed. R. Civ. P. l6(b). Similarly, Local
6 Rule 40.2(b) of the District of Arizona authorizes courts to grant a trial continuance "as
7 justice requires?
8 It is anticipated that the trial can go forward within sometime after February l, 2006.
9 This motion is unopposed by counsel for Plaintiffs.
