as Trustee of the DMX Creditors Liquidating Trust ("Plaintifi°’} and Defendant Dreamworks
Distribution, LLC (“Dei`endant"), pursuant to that "Settiement and General Release Agreement" i
between Plaintiff and Defendant (the "Sett1ement Agreement").
As permitted under Federal Ruie of Bankruptey Procedure ?G41 and Federal Rule ef
Civil Procedure 41(e)(l), the parties to this Stipulation of Dismissal hereby stipulate and agree
that, immediately upon filing of this Stipulation ef Dismissal, the abevewaptioned civil case. will
