Statement Of Issues On Appeal
Appellant, by and through its undersigned counsel, designates the issues on
appeal to include the following:
l. Whether the Court erred in granting the Motion of the United States
Trustee to Convert Chapter ll Case to a Case Under Chapter 7, or in the Alternative to Dismiss.
2. Whether the Court abused its discretion in converting the Debtor’s
Chapter ll case to a case under Chapter 7 pursuant to ll U.S.C. § lll2(b) without considering
whether or not conversion or dismissal was in the best interests of creditors.
A 3. Whether the Court erred in considering the Motion of the United States
Trustee without adequate notice to creditors and parties-in-interest.
