Instructions for Notice and Admission of Service of Summons and Complaint Form
The Notice and Admission of Service of Summons and Complaint asks the Defendant to admit that he or she has received a copy of the Summons and the Complaint. You should use this form if you think that the Defendant will sign it and return it promptly. Otherwise you should have the summons and complaint served by the sheriff or a process server. In that case you do not need to use this form at all. The Defendant is not required to sign the Notice and Admission of Service of Summons and Complaint, but not signing it and mailing it back to you can result in the Defendant having to reimburse you for the cost of service by the sheriff or other process server. If the Defendant chooses to sign the Notice and Admission of Service of Summons and Complaint, he/she should complete the form and return it to you. A copy should be kept by the Defendant for his/her records. You (Plaintiff) must file the original with the Clerk of Courts. If the Defendant refuses to sign and return the admission of service you must have the summons and complaint served by the sheriff's office or another qualified person. The divorce may not be finalized until 60 days after the day of service. (The day of service is not counted.)
