The undersigned declares under penalty of perjury that the statements below are true and correct and requests that the court enter an order granting the motion for relief from stay filed by the above-named party. 1. The court docket in this case indicates that no response in opposition to the motion has been filed (or that any response filed in opposition to the motion was subsequently withdrawn), nor have I received any opposition statement. The Servicemembers Civil Relief Act of 2003 ("SCRA") does not prohibit the entry of an order by default based on the following. The respondent is not an individual. No individual against whom relief is sought has filed a Statement of Military Service, the documents filed in this case do not indicate that any such individual is a servicemember in military service, and declarant has no personal knowledge that any such individual is a servicemember or that SCRA protections otherwise apply. One or more individuals against whom relief is sought is a servicemember in military service but any such individual is represented by an attorney or SCRA protections do not apply for the reason(s) stated in an attached memorandum. I am unable to determine whether or not an individual against whom relief is sought is a servicemember in military service and understand that the court may require the posting of a bond before entering an order granting the relief requested.
