Defendant Wal~Mart Stores, Inc. ("Wa1—Mart") opposes Plaintiffs Motion to
Alter or Amend Judgment, filed October 25, 2007, on the grounds that Wal—Mart filed a notice of
appeal the same day and the Court presently lacks jurisdiction to consider the motion. United
Smres v. Lajko, 520 F.2d 622, 627 (3d Cir. 1975); 20 MooRn’s revamp Pnacrica § 303.32
(Matthew Bender 3d ed. 2007). p
For the same reason, WaI——Mart opposes Plaintiffs Motion for Enlargement of
Time tiled on October 25, 2007.
