Re: Novozymes A/S v. Genencor International, Inc., et al.

Dear Judge Jordan:
This is in response to the telephone inquiry from the Court on October 20, 2005,
and the letter of October 19, 2005 irom Genencor. Novozymes responds that it too, is willing to
forego a Mczrkmcm hearing in this action, in contemplation of an early trial date. Novozymes
does not object to the scheduling of a trial during the first quarter of 2006, and if convenient to
the Court, would request that the trial be scheduled for early January 2006. Novozymes
understands that the Court is contemplating a three day bench trial (possibly with extended trial
days) on the issues of liability only, and that damages issues would be bifurcated and the subject
of later proceedings.
Novozymes agrees to this approach whether or not the Court contemplates issuing
an order on construction of the claim terms in dispute before the trial. However, Novozymes
submits that these issues have already been briefed and argued as part of Novozymes’
preliminary injunction motion presently before the Court. As these issues are ripe for decision, it

would be most helpful to the parties’ efficient preparation for trial if such claim construction
issues were resolved before trial.
