Per the Court’s Order of June 12, 2003, the above ited case was ismissed
without prejudice to the plaintiff moving to reopen on or efoiie July 7, 2 03 due t0
the court being advised that the case had been reported s selitled. Plai tiffs last
two motions for an extension until November 10, 2003 a cl tlien to Dece ber 10,
2003 have been referred to Magistrate Smith but no ruli gs such ext nsions '
have been made to date.
Although the parties have made substantial progr ss drafting he
settlement agreement to implement the agreed upon sett emecnt terms, ninth
extension is requested up to and including January 10, 2 04 order to omplete
