l conditions and terms as follows: 1) The defendant will participate in a program of substance abuse monitoring, counseling, .
and treatment under the direction of the Probation Office; 2) The defendant will participate in a program of mental health ,
evaluation counseling and treatment under the direction of the Probation Office, the defendant will pay all or a portion of the l
cost associated with his participation in these programs based on his ability to pay in an amount to be determined by the l
Probation Officer. The offender is scheduled to complete supenriseci release on January 27, 2010.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT AND FOR CAUSE AS FOLLOWS:
The defendant is being cited for violating the following condition of supervised release:
Charge No. 1 - Condition Violated I
Mandatory Condition: "You shall refrain from unlawful use of a controlled substance and submit to one drug test within 15 days
of release on probation and at least two periodic drug tests thereafter as directed by the probation officer." j
The offender has tested positive for opiates ten times between May 2006 and February 2007. Mr. Barretta also admitted that N
he used heroin on February 17 and March 6, 2007.
PRAYING THAT THE COURT WILL ORDERt tthis etition will serve as a summons directing Frank Barretta to i

supervision should not be revoked.
