moves for summary judgment on each of Plaintiff s six causes of actionI in his Substituted

enforceable; (iv) EDR had legitimate non—discriminatory reasons for ter1Ininuting Kern’s
employment; and (v) Kern was appiised by EDR ofthe substance of its Izounterclaims bqiore he
tiled his EEOC charge, and, therefore, the counterclaims were not filed retaliationfor Kern I
filing an EEOC charge. Moreover, the record necessitates the entry of aIjud;gment against Kern
on EDR’s counterclaims because: (i) Kem has not answered EDR’s couihterclaims and, therefore, I
the allegations in the counterclaims are deemed admitted; (ii) KemlbecaIne an agent of EDR’s I
direct competitor in violation of his non-competition agreements; and (iiIi) Klern admits that he I
submitted expenses for reimbursement that were in excess of that which Ihe actually incurred on I
business-related travel. I
For these reasons and those stated in the supporting Memoranduén of Law and Appendix I
filed herewith, Defendant respectfully requests that the Court enter sumijhary judgment
dismissing Plaintiff s Complaint in its entirety with prejudice, finds PlaiI1tiff liable on each of l
