1. Rules of Civil Procedure Rule 12(c) Motion for Jud ment on
The Pleadings. After the pleadings are closed but within such I
time as not to delay the trial, any party may move for judgment I
on the pleadings. If, on a motion for judgment on the pleadings,
matters outside the pleadings are presented to and not excluded \
by the court, the motion shall be treated as one for summary judg— {
l ment and disposed of as provided in Rule 56, and all parties
shall be given reasonable opportunity to present all material
r nmade pertinent to such a motion by Rule 56.
2. Rule 56(a) For Claimant. A party seeking to recover upon a 3
claim, counterclaim, or cross-claim or to obtain a declaratory `
judgment may, at any time after the expiration of 20 days from
the commencement of the action or after service of a motion for
summary judgment by the adverse party, move with or without sup-
porting affidavits for a summary judgment in the party's favor
upon all or any part thereof. l
