MOTION TO VERIFY IF AN APPEAL IS PENDING
NOW COMES petitioner, _______________________________________, by and through his/her attorney(s),

__________________________________________, and moves this Honorable Court to order the Clerk of the Circuit Court of Cook County to inspect the impounded file of Child Protection case no.__________________________, and

advise the Court if an appeal of the order terminating parental rights is pending. In support of this motion, petitioner states as follows: 1. The parental rights of the biological parents of the minor(s) in the above-captioned Adoption case were terminated in Child Protection court, case no. ____________________, on _____________________________.

At least 35 days have passed since the parental rights were terminated. It is the best interest of the minor(s) seeking adoption to determine if an appeal of the order terminating parental rights is pending in the Child Protection case referenced in paragraph one above. It is the best interest of the minor(s) seeking adoption to ensure that the above-captioned Adoption case proceeds with the primary goal of finality and stability. Any appeal pending in the Child Protection case referenced in paragraph one above affects the finality and stability of the above-captioned Adoption. The Petitioner in the above-captioned Adoption case has a need to know whether an appeal has been taken from the termination of parental rights order in the Child Protection case referenced in paragraph one above.

WHEREFORE, petitioner respectfully requests that this Honorable Court order the Clerk of the Circuit Court of Cook County to do the following: a. b. c. d. Inspect the court record of Child Protection case no.__________________________; Notify this Court if an appeal of the order terminating parental rights is pending; Notify this Court if a mandate has been issued; and Provide this Court with a photocopy of any mandate issued with regard to an appeal in Child Protection case no.__________________________.
