MOTION FOR WAIVER OF SPEEDY TRIAL Pursuant to the Speedy Trial Act of 1974, 18 U.S.C. §3161(h)(8)(A) and the Local Speedy Trial Plan, the defendant, Orville Lipscome, respectfully requests that the Court continue sentencing in this matter from May 24, 2005, until June 10, 2005. This request is being made for the following reason: 1. The undersigned counsel is scheduled to begin a trial in United States District Court in New Haven before Judge Peter C. Dorsey in the matter of Burke v. Mormino, CIVIL NO. 3:04cv771 (PCD), on Monday, May 23, 2005. Said trial is expected to continue through Wednesday, May 25, 2005. The waiver has not yet been signed by the defendant as of today's date, although he has been informed orally of the change by undersigned counsel and has given his consent orally to said continuance. WHEREFORE, the defendant request that his motion be granted.
