GUIDELINES FOR REQUESTING CLERK'S ENTRY OF DEFAULT Under Rule 55, F.R.Civ.P., when a party has failed to appear and defend within the prescribed time limits, application may be made for default. This office requires the following: 1. Praecipe (requesting Clerk to enter default) 2. Affidavit of Non-Military service (a) this is for individuals only (b) not needed for corporations (c) Soldiers & Sailors Act of 1940, 50 USC governs Non-Military Affidavit 3. Affidavit of Sum Certain 4. Motion for Entry of Default 5. Proposed Default Judgment Order Once the above has been done, the Clerk's Office will verify that service has been affected. If so, the Clerk's Office will prepare and process the Clerk's Entry of Default.
