employee who is not exempt . . . for all hours of work in excess of 8 in a day or 40 in a workweek at a rate equal to one and one-half times the employee=s hourly regular rate of pay.@ 3. During the phase of this case focusing on Concord plaintiffs= claims, plaintiffs=
counsel negotiated payment for plaintiffs' incidental straight time claims. Defense counsel seemed amenable to settling these claims and counsel for the parties even agreed on tentative settlement figures, including straight time claims, for many Concord plaintiffs. However, in October 2006, defense counsel reversed course and informed plaintiffs that defendant would not agree to compensate plaintiffs for any straight time hours. Plaintiffs' counsel moved to amend within a reasonable period of time after being notified of defendant's position. 4.
