STATUS REPORT IN ACCORDANCE WITH THE COURT'S ORDER OF APRIL 18, 2007 In accordance with the Court's Order of April 18, 2007, Docket No. 286, the parties have consulted and file the following report. 1. AGREEMENT ON STIPULATIONS FOR TRIAL

Plaintiff's Statement: On May 4, 2007, Sparton submitted 393 proposed stipulations of fact to the Government. On May 18, 2007, the Government responded thereto, totally admitting 98, admitting in part 36 and denying 259 of them. While some accounting base contract values were conceded by the Government in its response to the proposed stipulations of fact, others were not even if they varied by about a dollar from Sparton's proposed contract value stipulations. Similarly, Sparton's proposed stipulations of fact relating to the descriptions of the accused devices given by government contractor Rule 30(b) (6) employees in their depositions, with the exception of release plate configurations, have not been conceded by the Government. This may have a far reaching effect upon trial in terms of the number of witnesses that may need to be called and the number of trial locations that may need to be scheduled.

Defendant's Statement: On July 26, 2006, the Government submitted 414 proposed stipulations to Sparton. Sparton replied on August 30, 2006, agreeing to 71 stipulations entirely and another 13 in part and denying the remainder. As indicated by Sparton, it submitted 393 proposed stipulations on May 4, 2007. The Government responded on May 18, 2007, as indicated above. Substantial difference exists between the parties on at least the following issues: (1) characterization of various parts of the accused devices (particularly whether or not certain parts correspond to the limitations of the claims); and (2) the amount of certain payments by the Government (including whether those numbers should be rounded and, if so, how).

DECLASSIFICATION OF DOCUMENTS

Plaintiff's Statement: The Government has declassified some, but not all, of the classified documents which may be used at trial. Defendant's Statement: The Government's review of documents for declassification was completed on December 15, 2006 with the forwarding to Sparton of portions of two documents that were declassified and amended interrogatory answers relating to those documents.

REMOVAL OF PROPRIETARY LEGENDS

Plaintiff's Statement: By letter dated October 24, 2006, in response to Sparton's August 16, 2006 letter, Hermes (by its successor in interest) informed Sparton that the information contained within the produced documents previously deemed proprietary by Hermes is not -2-

proprietary and does not require removal from said produced documents. By letter dated August 18, 2006, in response to Sparton's August 16, 2006 letter, the Boeing Company, successor in interest to the Rockwell International Corporation, informed Sparton that it has no objection to removing, in the above captioned matter only, the legends on, and using Boeing proprietary data within, the documents used as exhibits in the 1998 depositions of Carl Carrera and Don Pickrell. Defendant's Statement: The Government completed review of its documents that bear proprietary markings and has responded to all requests by Sparton. The Government has not received copies of any of the letters referenced in Sparton's statements. Sparton itself has not yet agreed to remove proprietary markings from its own documents.

SCHEDULE FOR TRIAL AND LOCATION OF TRIAL

The parties are in agreement as to dates and have attached a copy of the proposed pretrial order with those dates filled in at the appropriate locations. The parties disagree as to the location of trial. Plaintiff's Statement: Trial should be held in or near the following locations: Jackson, Michigan; DeLeon Springs, Florida; and Washington D.C. Other trial locations will become necessary if the description of the accused devices given by government contractor Rule 30(b)(6) employees in their depositions is disputed by the Government. In this event, trial locations in Boston, Massachusetts (for Sippican, Hazeltine and Raytheon), Anaheim, California (for Rockwell), Ft. Wayne, Indiana (for Magnavox), and Nova Scotia, Canada (for Hermes) may be necessary.

Defendant's Statement: Trial should be held at Washington, D.C. Sparton has expressed a desire to have a session of trial in Jackson, Michigan due to the health of one of its witnesses. The Government has no objection to that request. Sparton's remaining requested trial sites would be unduly burdensome and are unnecessary; the witnesses can appear in Washington. We also note that holding trial in Nova Scotia would violate Canadian sovereignty, and probably would not be allowed by the Canadian government.

1 The exchange of information before the meeting of counsel, especially the exchange of objections, should facilitate resolving issues at the meeting of counsel without Court involvement. Counsel, therefore, should act in good faith to list all witnesses,, exhibits, and objections in these "preliminary" exchanges. Although counsel will eventually file final lists with the court, the opportunity for another filing should not be used as a method for circumventing the requirement of providing preliminary information. Facts that support more than one legal contention do (d) not have to be repeated completely; they may be identified by number for successive legal arguments. Plaintiff shall serve its witness list (which should include the witnesses who will be called in rebuttal, to the extent that they are known) on the same date as it serves its Proposed Findings of Fact: The witness list shall specify those witnesses (a) identified as supporting facts in Plaintiff' s Proposed Findings of Fact. For each witness, Plaintiff shall indicate the specific (b) topics to be addressed in the expected testimony by identifying the facts (by fact number) that the witness will establish. The meeting of counsel shall be held on or before * . (at least 63 days before the pretrial conference; see Appendix A, ¶ 13). Counsel shall follow the requirements set forth in Appendix A, ¶13, to the extent not otherwise addressed in this Order. At the meeting, counsel shall also discuss the sequestration of witnesses under Fed. R. Filings After Meeting of Counsel
No later than one week following the meeting of counsel, counsel shall file the following:.

A Joint Notice of Proposed Procedures for Sequestration, if sequestration is requested by either party. If the parties have not been able to agree on such procedures, they shall .separately file memoranda on sequestration by this date (this Joint Notice shall be filed as a "Notice" under ECF and linked to this Pre-Trial Order). Any motions, pursuant to Appendix A, ¶ 15(b), for leave to present substantive evidence by way of deposition testimony. Such motions shall list the pages of such transcripts but shall not include copies of the listed pages. Any objections, including motions in limine, to the opposing party's proposed witnesses or exhibits. For each objection, the objecting party shall identify the witness or exhibit as proposed and the grounds for the objection.

No later than two weeks following the meeting of counsel, the parties shall file: (1) Any objections, including the grounds therefor, to the opposing party's motions regarding deposition testimony and any proposed cross-designation of transcript pages. In cross-designating, the party may not simply designate the entire transcript. A. Joint Stipulation of Facts, Witnesses, and Exhibits as follows: (a) a statements of the facts on which the parties agree, separately numbered and based on the parties' Proposed Findings of Fact; a'listing of all witnesses to which neither party objects, with (b) a brief description of each such witness; a descriptive listing of all exhibits to which neither party (c) objects on the grounds of authenticity or admissibility (two sets of such exhibits shall concurrently be provided to chambers). Each party's Proposed Findings of Fact, other than j~)intly stipulated facts, separately numbered with underlining designating the portion in dispute, in the same format as prescribed in paragraph 2.a.i.(1).

Each party's Final Witness List, including a brief description of each witness and denoting stipulated witnesses, in the same format as prescribed in paragraph 2.a.i.(2). Each party's Final Exhibit List, and a set of such exhibits, excluding joint exhibits, in the same format as prescribed in paragraph 2.a.i.(3) (two sets of such exhibits shall concurrently be provided to chambers).

Memorandum of Fact and Law (1) No later than three weeks after the meeting of counsel, Plaintiff shall file a Memorandum of Fact and Law. (a) The Memorandum of Fact and Law shall set forth Plaintiff's conclusions of law with a complete exposition of the legal theory that supports each legal claim. Based upon its Proposed Findings of Fact, Plaintiff shall (b) explain the factual basis upon which it relies to support its claims. With respect to all facts, Plaintiff shall reference its Proposed Findings of Fact, by number. Absent good cause, the memorandum shall not exceed 30 (c) pages. No later than four weeks after the meeting of counsel, Defendant shall file a Responsive Memorandum of Fact and Law in the same format as Plaintiff's Memorandum.

Matters of Style for Exhibits i.

Joint exhibits shall be prefaced with..... , Plaintiff'S with P , and aJ a ..... Defendant's with a "D." There shall be no duplication of exhibits.
Documentary exhibits shall be contained in binders and shall be numbered and paginated e.(&~., Plaintiff's Exhibit 5, page 10 shall be marked "P5.10"), with tabs demarcating each exhibit. The exhibits shall be accompanied by a table of contents listing and describing all exhibits in numerical order. Demonstrative exhibits shall also be assigned numbers, and described in the table of contents.

All officially admitted exhibits shall be submitted to the court reporter at trial at the time they are admitted for incorporation into the trial record (it may be appropriate to move the admission of joint exhibits at the onset of trial). A copy of each such exhibit shall concurrently be submitted to the judge's law clerk. In the unusual circumstance of any exhibits admitted at trial that were not previously listed and provided to chambers, the offering party shall submit such exhibit along with three copies (one each for the judge, the law clerk, and opposing counsel; the original of the exhibit shall be submitted to the court reporter).



Obiections Each objection shall provide the appropriate Federal Rule of Evidence number(s) and provide a short, narrative explanation of the basis for the objection. Informative cases maybe cited in support of the objection. ii. Motions in limine shall be utilized to present significant objections, including objections to the testimony and/or qualifications of expert witnesses. Objections to witnesses and exhibits shall be submitted in the time set forth in this order. Objections not so raised may be deemed waived. Motions in limine regarding other matters shall be filed at least two weeks before the pretrial conference.

Included should be all facts, all documents and papers or contents or aspects thereof, and all evidence which fairly should not be in dispute.

When the truth or authenticity of facts or evidence claimed to be relevant by one party is not disputed, an objection on the ground of materiality or relevance may be noted by any other party but is not to be regarded as just cause for refusal to stipulate. The requirement of stipulation applies without regard to where the burden of proof may lie with respect to the matters involved.

Binding Effect (1) A stipulation shall be treated, to the extent of its terms, as a conclusive admission by the parties to the stipulation, unless otherwise permitted by the court or agreed upon by the parties. The court will not permit a party to a stipulation to qualify, to change, or to contradict a stipulation, in whole or in part, except where justice so requires. A stipulation and the admissions therein shall be binding and have effect only in the pending case and not for any other purpose, and cannot be used against any of the parties thereto in any other case or proceeding.

Trial Methods. The Court is committed to cost-effective methods of resolving and trying cases. The parties should consider whether direct testimony submitted in written form may be preferable. Under this procedure, parties submit their witnesses' affirmative testimony in writing in advance. The witnesses are then subject to cross-examination before the court in open court.

Pre-trial conference. \The pretrial conference will be held in person at the U.S. Court of ' ~* -~ * at * but laterthan ~4X- [day[, ____!k__ [date], ~ [time], no two weeks prior to trla" 1 and at least two weeks after the filing of Defendant's Responsive Memorandum of Fact and Law. In such event, at least one business day before the conference, counsel shall
